Fred Perkins is the co-chair of Morrison Cohen’s Technology, Data & IP Department and co-chair of the firm’s Alternative Dispute Resolution Practice Group. For over 35 years, clients have trusted him to negotiate and litigate their critical intellectual property matters.

Fred represents clients on IP issues including trademark, trade dress, copyright, unfair competition, trade secrets, false advertising, defamation, patent, antitrust, licensing, entertainment/artist/literary rights, publicity/privacy rights, software, and internet/website. He also handles a variety of complex business litigations, including in the areas of mergers/acquisitions, securities, employment, creditors' rights, fraud, products liability, trusts and estates, insurance coverage, and real estate. 

While Fred has won several multimillion-dollar judgments on behalf of his clients, some of his greatest litigation accomplishments were achieved outside the courtroom using his negotiation skills to resolve numerous difficult and intractable cases. He has effectively mediated many cases, both as an advocate and a professional mediator. He has served as a professional mediator for over 30 years and has mediated cases for numerous parties both privately and as a court-appointed mediator for the Southern District of New York. 

Clients also rely on Fred for protection of their IP rights and portfolios across a broad spectrum of entertainment, sports, high-tech, software, academic, media, publishing, marketing, financial, fashion, industrial and consumer product fields. As a result, he is experienced at both negotiating and documenting IP transactions as well as litigating such matters.

Fred is a thought leader on IP matters, serving as a speaker at various IP and litigation seminars and sharing his insights in national publications.

Fred began his career as a law clerk to the Hon. Jacob Mishler, former Chief Judge of the Eastern District of New York. After his clerkship, he worked for several years at Kramer Levin Naftalis & Frankel LLP.

 

Experience

  • Successfully tried a fraud claim against a public company on behalf of one of its subsidiary's former executives; obtained an award of substantial damages and all of client's attorneys' fees
  • Successfully tried an M&A dispute on behalf of a purchaser in a complex acquisition for breach of representations and warranties; obtained a multi-million dollar damage award
  • Successfully tried an IP and unfair competition dispute between competing securities firms; obtained a multi-million dollar damage award
  • Obtained preliminary injunctions on behalf of various clients protecting their IP rights and enjoining infringement
  • Obtained summary judgment on behalf of major electronic publisher dismissing various copyright claims
  • Recovered infringing internet domains from cybersquatters on behalf of several clients through numerous ICANN arbitrations and other proceedings
  • Successfully prosecuted and defended numerous trademark claims before the Trademark Trial and Appeal Board of the United States Patent and Trademark Office
  • Negotiated numerous IP licensing and other agreements with National Hockey League, Minor League Baseball, Google, Yahoo, Fox, CBS, Sun Media and various other media and entertainment entities
