Hon. David B. Saxe Quoted in New York Times on Appeals Court Decision to Lower Trump’s Half-Billion-Dollar Bond

Morrison Cohen Partner Hon. David B. Saxe (Ret.) was quoted in a New York Times article on March 25, 2024 entitled “Trump’s Bond in Civil Fraud Case Is Reduced to $175 Million.”

The article discussed the decision of a New York appeals court to accept a $175 million bond from former president Donald J. Trump in his civil fraud case, as opposed to the original bond of nearly half a billion dollars. The ruling by a panel of five appellate court judges was a crucial and unexpected victory for Mr. Trump.

Justice Saxe, a former judge in the New York State Appellate Division, First Department – the same court that ruled on Monday – said that the court’s decision suggests some of the judges were uncomfortable with Justice Arthur F. Engoron’s ruling in the civil case. “My view is that the court indicates it has difficulty with the breadth of the lower court’s decision. They had other options available to them, and they issued a broad-based stay,” which he said suggests “there is a view that they’re going to need to take a hard look at the lower court’s decision.”
