It was a winning weekend for four of our clients, who scored major litigation victories right before the July 4th holiday. Morrison Cohen litigation teams successfully represented:

• Maiden Holdings in obtaining an affirmance by the Administrative Review Board of the dismissal after a 37-day trial of a SOX whistleblower claim seeking $50 million in damages. • Arch Companies affiliate Nostrand Senior Lender LLC in defeating an adversary’s emergency request for an interim appellate stay. The adversary sought an emergency stay of a determination clarifying a receiver’s powers to manage the underlying property, which is being foreclosed upon. • Treeline 175 Remsen, LLC in obtaining a reversal in the Appellate Division, Second Department. In this trespass case, the trial court declared an easement terminated but declined to direct a damages inquest. The Second Department reversed the trial court in part and remanded for a damages inquest. The litigation team included Y. David Scharf, Gayle Pollack and Michael Mix. • A shareholder in Fabuwood Cabinetry Corp., who was granted an award of arbitration in a hotly contested shareholder valuation dispute where the petitioner made a motion to reject the award of arbitration on the grounds of arbitrator misconduct.
