Recently, Morrison Cohen partners Y. David Scharf and Danielle C. Lesser, and associate David C. Pollack, authored an article in the Commercial Litigation Insider, addressing the tort of malicious prosecution and its potential as a remedy for clients sued for dubious, but highly publicized, allegations of wrongdoing. Although malicious prosecution can be a very difficult claim to make, when each of its elements are met, an action – or even a credible threat of it – can provide redress from frivolous attacks and help deter them in the future.
