Genny Ngai Shares Insights on the U.S. States’ Varied AI Laws in Women in AI Blog

Morrison Cohen White Collar and Regulatory Enforcement Partner Genny Ngai published an article entitled “AI Laws in the United States: Are Tougher AI Regulations Really Viable?” on the Women in AI Legal Insights Blog. In the article, she examined the differences in AI laws among the U.S. states in the absence of federal regulation, discussed the viability of these laws and provided some key takeaways.

Genny, a former federal prosecutor with over 10 years of criminal and civil litigation experience, explained that unlike the EU’s AI Act in Europe, the U.S. currently operates under a patchwork system of AI legislation, with regulations differing from state to state and, in some cases, even at the local level. Colorado, for example, has implemented a stricter framework for high-risk AI, drawing criticism for its complexity, while Utah has opted for a lighter approach to encourage innovation.

Genny shared some key takeaways from the states’ dueling approaches, including:

  • The more complex or onerous the AI law is, the harder it will be to implement
  • Until there is a federal solution, AI law in the U.S. will only become more disparate and will be dependent on states’ interest in attracting AI investments and jobs
  • Despite challenges, more AI laws will be passed in the U.S., providing guidance for companies on future compliance
  • Companies should consider disclosing their use of generative AI, as transparency-focused laws like the UAIP are gaining traction and may influence other states
