Morrison Cohen Appellate Practice Lawyers Co-Author Article in New York Law Journal on Merits of Pre-Argument Conference in Appellate Court
Hon. David Saxe (Ret.), a former Associate Justice in the New York Supreme Court Appellate Division, First Department and leader of our Appellate group, and Associates Joseph Kamelhar, Mahnoor Misbah and Sydney Reade recently co-authored an article in New York Law Journal entitled “The New Pre-Argument Conference at The Appellate Division, First Department.” In the February 1, 2023 article, the authors discuss the merits of the pre-argument conference, or “Conference before the Conference" (CBC), a procedure that has developed organically over the last 10 years, as championed by Presiding Justice Rolando T. Acosta and members of the court.
The authors state that the CBC “has had the effect of not only improving productivity at the court but at the same time has empowered and prepared judges to be even more laser-focused participants in the upcoming oral arguments at the Appellate Division, First Department.” The authors recommend that any “appellate court especially an intermediate appellate court with a huge inventory of appeals” consider the CBC process.
