In an article published in the June 1, 2020 edition of Risk Management Magazine, Keith A. Markel, Partner and Co-chair of Morrison Cohen's Labor & Employment group, along with Labor & Employment Associate, Theresa D'Andrea, highlight some important reminders to assist employers in minimizing certain areas of potential liability that employees may face with employees working remotely.
With large portions of the U.S. workforce working remotely, and potentially remaining that way for the immediate future, employers should make certain that workplace policies that were applied and enforced as part of their in-office operations remain in effect in the remote office landscape - from safeguarding the integrity of virtual collaboration tools like chat and email systems to ensuring appropriate workplace behavior on videoconferencing platforms. Employers should continue to take proactive measures to create and ensure that remote work policies are also implemented, reinforced, and applied uniformly and in a non-discriminatory manner.
